You will be charged your plan price on your renewal date unless you cancel. Access continues until the end of your current billing period after cancellation. Cancel anytime in Settings > Subscription.
By accessing or using Sitemark (sitemark.ai) or creating an account, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use Sitemark.
These Terms form a legally binding agreement between you (and your organization, if applicable) and Hughes Construction Products Group Inc. ("420 Industrial Blvd, Nash, TX 75569"). For legal inquiries, contact legal@sitemark.ai.
AUTO-RENEWAL DISCLOSURE
YOUR SUBSCRIPTION AUTOMATICALLY RENEWS at the end of each billing period (monthly or annual, as selected). You will be charged your plan's price on your renewal date using the payment method on file, unless you cancel before the renewal date.
To cancel: Go to Settings > Subscription and follow the cancellation instructions. You may cancel at any time. Access continues until the end of your current paid billing period. No partial-month refunds are provided (see Section 9).
GradeLog Trial Access
Trial access to Sitemark/GradeLog is a one-time gift associated with eligible equipment purchases from Express Tools or authorized dealers. Trial access is not transferable, cannot be sold or gifted to third parties, and is valid for a single user account. After trial expiration, a paid subscription is required to continue accessing premium features. Sitemark reserves the right to modify or discontinue trial programs at any time.
You retain full ownership of all field reports, photos, documents, and other content you upload to Sitemark ("Your Content"). We do not claim ownership of Your Content.
By uploading content to Sitemark, you grant us a limited, non-exclusive, worldwide license to store, process, and display Your Content solely to operate and deliver the Sitemark service to you. We do not use Your Content for advertising, train AI models on your proprietary field data without consent, or share it with third parties except as necessary to provide the service (see Privacy Policy).
AI Disclaimer
Sitemark uses Anthropic Claude to power our AI Field Assistant. AI-generated content is for informational purposes only and should not replace professional judgment. Field measurements, grade calculations, and site documentation require verification by qualified personnel. Do not rely solely on AI-generated output for safety-critical decisions, structural work, or regulatory compliance. Express Tools and Sitemark are not liable for decisions made based solely on AI-generated content.

How to Cancel
You may cancel your Sitemark subscription at any time from your account Settings > Subscription page. Cancellation takes effect at the end of your current billing period — you will retain full access until that date. We do not prorate or refund unused portions of your subscription period.
If you believe content on Sitemark infringes your copyright, send a DMCA takedown notice to:

Your notice must include: identification of the copyrighted work, location of the infringing material, your contact information, a statement of good faith belief, and your signature (electronic is acceptable).
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SITEMARK, ITS OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO SITEMARK IN THE 12 MONTHS PRECEDING THE CLAIM.
Sitemark is a documentation and reporting tool. It does not replace engineering judgment, safety inspections, or regulatory compliance review. Field measurements must be verified by qualified personnel.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Legal actions arising from these Terms shall be brought in the state or federal courts of Texas, and you consent to personal jurisdiction in those courts.
Contact us at legal@sitemark.ai before filing any legal claim. We will make a good-faith effort to resolve disputes within 30 days.
Unresolved disputes shall be settled by binding arbitration under AAA rules, on an individual basis. You waive the right to participate in class action litigation or class-wide arbitration.
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of Sitemark after changes take effect constitutes your acceptance.
